Gun Safety Awareness

Posted Date: 11/14/25 (05:00 PM)

Good Afternoon, Buckeye Parents,

We at Gilmer ISD cannot stress the importance of parental responsibility for safe firearm storage in your home. According to House Bill 3, the Texas School Safety Center, in collaboration with the Texas Department of Public Safety, has been tasked with providing each school district and open-enrollment charter school with safe firearms storage information and resources for distribution to parents and guardians. Please see the following statement concerning the parents' responsibility for firearm safety. This broad spectrum of material includes information from Section 46.13 of the Texas Penal Code.
“IT IS UNLAWFUL TO STORE, TRANSPORT, OR ABANDON AN UNSECURED FIREARM IN A PLACE WHERE CHILDREN ARE LIKELY TO BE AND CAN OBTAIN ACCESS TO THE FIREARM.”
The following are the definitions from Section 46.13:
Child – any person younger than 17 years of age
Readily dischargeable firearm – a firearm that is loaded with ammunition, whether or not a round is in the chamber
Secure – to take steps that a reasonable person would take to prevent access to a readily dischargeable firearm by a child, including but not limited to placing a firearm in a locked container or temporarily rendering the firearm inoperable by a trigger lock or other means
A person commits an offense under Section 46.13 of the Texas Penal Code if a child gains access to a readily dischargeable firearm and the person with criminal negligence:
 (1) failed to secure the firearm;  or
 (2) left the firearm in a place to which the person knew or should have known the child would gain access

Thank you for your help and assistance as we work together to protect our students.
